THANK YOU FOR CHOOSING COCOBAY RESORT.  THE BELOW TERMS AND CONDITIONS GOVERN THE USE OF OUR WEBSITE, SERVIVCES AND ALL VERBAL AND WRITTEN AGREEMENTS AND CONTRACTS BETWEEN COCOBAY RESORT AND OUR VALUED GUESTS, PARTNERS, AGENTS & CLIENTS. PLEASE READ CAREFULLY BEFORE BOOKING AND CONTACT US IF YOU HAVE ANY QUESTIONS OR CONCERNS.

Covid-19 Policy

In consideration of recent concerns following the Covid-19 crisis and recommendations by the WHO, PAHO and CDC, the team at Cocobay has implemented advanced cleanliness and sanitation policies, rigid health and wellness guidelines and strict physical distancing measures. To ensure the safety of guests and staff, temporary restrictions may be placed on some of our in-house offerings and activities. During this period of uncertainty, Cocobay Resort will continue to work closely with local tourism and health authorities and international travel partners to ensure that decisions are made with the most accurate and up to date information.

For Direct Bookings made with Cocobay Resort your credit card will be charged a deposit of three (3) nights in order to confirm your reservation. Your reservation will not be confirmed until the deposit payment is received.

Final payment is required prior to check-in. Should you wish to update payment details, please contact us, otherwise the balance due on your reservation and pre-booked extras will automatically be charged to the same credit card above within two (2) weeks of arrival.

In the event that your balance payment cannot successfully be processed, Cocobay Resort reserves the right to cancel your reservation.

*DIRECT RATES ARE SUBJECT TO CHANGE DAILY BASED ON AVAILABILITY, AND ARE ALL INCLUSIVE OF MEALS, DRINKS & SALES TAX (Tourism Guest Levy of US$5 per guest per night not included and will be charged at the resort). 

Rates are final and cannot be adjusted or amended with new discounts or lower rates after booking is confirmed.

Bookings made through tour operator partners, online booking sites or Travel Agents may be subject to different payment terms. If a third party operator or site fails to remit payment to the Resort on behalf of a guest, the guest will be required to cover the full cost of the booking before access is granted to the resort.

A third party (e.g Travel Agent) wanting to pay for entire or part of the charges for a booking – must provide a completed credit card authorization form, signed by the card holder, as well as a copy of the front and back of the same credit card  and valid ID matching the name on the card.

  1. Incidentals, Extras and Amenities booked or reserved with the hotel ahead of arrival are not confirmed until payment is received by the resort and confirmation is sent via email.

  2. The Resort accepts Visa, MasterCard, Discover Card and American Express. In some instances alternate payment methods will be accepted subject to discretion and bank confirmation.

The Guest is responsible for reviewing all flight schedules, advisories and details, for accuracy and availability and providing this information to the Resort where pick up is necessary.

Taxis are typically readily available outside the airport’s baggage claim area and at the resort, however private transfers and prearranged pickup may be available at an additional cost.

Cocobay Resort shall NOT be liable for refunds, credits, rescheduling or any other form of compensation due to travel delays, flight cancellations or guest inability to travel for any reason.

Travel Insurance is strongly recommend to cover such occurrences.

Cancellation  Policy 
 
Standard bookings cancelled earlier than 30 days prior to arrival will attract a one (1) night cancellation penalty. Bookings cancelled within 30 days of arrival will incur a cancellation penalty of three (3) nights. The full cost of the booking will be charged for cancellations within 14 days of arrival, no-shows, early departures or Non Refundable Bookings.
 
Amendment Policy 
 
Date changes made within 45 DAYS prior to arrival may be allowed, subject to availability. If availability is confirmed, a change fee of $150 per room shall be charged to guest.
 
Downgrades will be treated as a cancellation. Applicable penalties will apply. 
 
Cancellation of Extras
 
Cancellation of Extras, incidentals and pre-booked events within 24 hours of Reservation time will result in a penalty of 50% of the cost of the item.
  •  
Check-in time is 3:00 p.m., and check-out time is 12:00 noonSubject to availability, early check-in or late check-out may be available for an additional fee payable locally at the Resort.
    •  All guests will be required to pay the newly introduced Antigua Tourism Guest Levy of $5 USD per person per night stayed, to help establish a Climate Resilience and Development Fund. The Levy will automatically be charged to the room account at the end of each stay, collected by the hotel on behalf of the Government of Antigua and Barbuda and remitted in full to the Inland Revenue Department. 
 
  • Children under 18 & pets/animals are not allowed at the resort.
 

Upon check-in at the Resort, the lead Guest on the booking must provide a valid Passport as well as a valid Credit Card (Visa, Mastercard, Amex, Discover). *Guests who booked directly with the hotel will be asked to present a copy of the card used to make the booking for security purposes.

In the absence of a credit card, a cash deposit of US$200.00 will be required for use towards incidentals, with any unused amount returned upon checkout. Before checking in to Cocobay, all Guests shall be required to complete and sign the resort’s Web Check-in /Guest Registration form, confirming agreement with the terms and conditions of the resort. The signature on the web check-in/registration form must match signatures on the credit card, ID and any other documentation as provided by the guest.

For Departing Guests: All room and incidental balances and fees must be settled and confirmed via Reception before the guest departs. Any unpaid balances or damages to resort property will be charged to the card on file. 

We know you don’t want to leave any family members behind, but animals and pets are not allowed at the Cocobay Resort.

For the benefit of everyone, smoking is not permitted in any of the guest rooms, inside of the hotel or lobby area nor in restaurant dining areas/bars. Any evidence of violation of our smoke free policy will result in a USD$250 deep cleaning charge, along with additional fees as assessed by Management.

For the safekeeping of valuables, a safe is provided in the room. Cocobay Resort will not be liable for loss of any valuables not protected in this manner. Any issues regarding missing valuables, lost safe keys or damage to the safe will be investigated by Resort Management and Law Enforcement Authorities and a charge will be incurred for any loss/damage by guest.

Elegantly casual, smart, resort attire is required in all restaurants, lobbies and admin areas. This may include tailored pants, collared shirts, casual shoes and covering for bathing suits – no sportswear.

Strict adherence to dress policies may be enforced by Management at specific times, events or locations.

Please let us know if you have any food allergies or intolerances  and we will make every effort to accommodate your dietary restrictions. The Resort’s restaurants, bars and other dining offerings use wholesome ingredients, which may include milk, shellfish, shrimp, wheat, seeds and other possible allergens and we cannot guarantee that culinary offerings will not come in contact with these items.

Guests with food allergies or dietary restrictions are advised to take all the necessary precautions.

Due to the rugged landscape and unique nature of the terrain and grounds, Cocobay Resort may not be suitable for Guests with severe disabilities and/or mobility issues. Some cottages, beaches, amenities and services may not be accessible and guests with limited mobility may have difficulty enjoying some of the resort experiences.

The Covid-19 Corona Virus has impacted almost every country and has posed a serious challenge to the travel and hospitality industry. The Ministry of Health and Tourism Authorities have enforced very strict policies to control any importation and reduce the spread of the virus in Antigua. Cocobay Resort continues to abide by the latest local and international guidelines regarding managing the risks associated with Covid-19.

Antigua has been fully cleared and has had no recently documented cases of any insect- borne diseases. As with most tropical islands there may be a risk of  interactions with mosquitoes, sand flies, ants and other flying and crawling insects. However the Resort maintains rigid pest control programs and treatments and we encourage guests to use repellent and take all recommended precautions.

The Resort, its directors, management, staff and insurers shall absolutely NOT be liable for any injury, illness, or loss resulting from exposure to Covid-19 or any other insect borne, tropical illness.

The Resort, its principals, partners, agents or staff shall NOT be liable for any losses or damages due to events beyond their reasonable control. Such events, occurrences, or causes include, without limitation, acts of God, acts or orders of Governmental authorities, terrorist activities, pandemics, weather, strikes, lockouts, riots, utility outages, acts of war, earthquake, volcanic activity, ash clouds, tsunamis, fire, explosions, lightning, airline delays, cancellations or any event typically described as “force majeure” or an “act of God.”

Any additional costs, room nights or cancellation penalties incurred by the Guest, Agent or Operator will be due to the resort at established rates.

For Cocobay Resort cancellations, adjustments or amendments due to bad weather, all applicable booking costs, penalties and terms will apply unless otherwise authorized in writing by a representative of the resort.

For hurricanes or other severe weather conditions, Cocobay Resort Management will utilize all available and reasonable resources to ensure the safety and comfort of all guests, in accordance with Tourism Officials and our National Office of Disaster Services.

Travel insurance is strongly recommended for each guest.

Waiver and Release of Liability By Hotel Guests

 

I understand that in consideration of the pandemic COVID-19, I rented a room from Cocobay Resort (the “Hotel”)
The waiver, release and other representations and covenants set forth herein are given in consideration of the Hotel, and upon such reliance permitted me and/or my family and children to become a guest of the Hotel and occupy one of the rented rooms in the hotel.

Acceptance and Acknowledge of Risk:


I am fully aware and recognize that there are a number of risks associated with me, my family and/or guests entering on the Hotel’s property, becoming a hotel guest and/or occupying a room at the hotel during the pandemic COVID-19, including without limitation that:

  • I, my family and/or my child or our visitors could contract COVID19 and/or other similar or related diseases such as the flu or
    legionnaires disease which could result in a serious medical condition
    requiring medical treatment in a hospital or could possibly lead to
    death; and
  • I and my family and/or my child or our visitors will be subject to
    normal risks associated with staying in a hotel such as physical injuries
    or even death or loss or damage to personal property, including
    without limitation, from slips or falls, food poisoning or allergic reaction
    to food served in the hotel, physical or verbal altercations with hotel
    staff, or other guests, electrocution from appliances or equipment
    within the hotel, drowning in pools or tubs, terrorist or other violence,
    theft or vandalism, auto accidents around the hotel, or fires or other
    disasters affecting the hotel.

Express Assumption of Risk and Responsibility:


On behalf of myself, my family and/or my child and our heirs, successors
and assigns, I knowingly and freely, assume all such risks, both known and
unknown, relating to myself, my family and/or my child’s occupancy of a
hotel room and being a guest at the Hotel as described above, and I
hereby knowingly , intentionally and forever release, waive, relinquish, and
discharge the Hotel, along with its officers, directors, managers, officials,
trustees, agents, employees, and/or other representatives, and its
successors and assigns (collectively, the “Hotel”), from any and all claims,
demands, liabilities, rights, damages, expenses, and causes of action of
whatever kind or nature, and other losses of any kind, whether known or
unknown, foreseen or unforeseen, (collectively, “Damages”) as a result of
myself, my family and/or my child being a guest at the Hotel and
occupying a room at the Hotel as described above, including but not
limited to those related to the above described personal injuries, disease,
death, property losses, or any other loss, and including but not limited to
claims based on the alleged negligence of the Hotel.

Release & Indemnity:


I do for myself, my family and/or my child and our heirs, successors and
assigns, further agree not to sue or bring any claim for relief against the
Hotel collectively, and further agree to wholly indemnify and hold the Hotel
harmless from any and all damages suffered by myself, my family’s and/or
my child’s as a result of being a guest or occupying a room at the Hotel.

Declaration:


I hereby declare that I understood the contents of this agreement and voluntarily
signed thereon.

Law and Jurisdiction:


This agreement shall in all respects be construed and operated in
conformity with the Laws of Antigua and Barbuda and the parties consent
to the exclusive jurisdiction of the Eastern Caribbean Supreme Court of
Antigua and Barbuda over any matter arising out of or in connection with
this Agreement.
